1. Acceptance of these terms
Welcome to MentionedBy.ai (“MentionedBy AI”, “we”, “our” or “us”), a product operated by Synapse Artificial Intelligence Labs. By creating an account, purchasing a subscription, accessing the platform or otherwise using our services (the “Service”), you agree to these Terms of Service and our Privacy Policy.
If you are using the Service for a company or other organisation, you confirm that you have authority to accept these terms on its behalf. If you do not agree to these terms, do not use the Service.
2. The Service
MentionedBy AI is a subscription-based software service that monitors and analyses how brands, organisations, people, products and other entities appear in generative-AI and answer-engine outputs. Depending on your plan, the Service may include monitoring, rankings, citations, alerts, competitive benchmarks, sentiment analysis, reports and optimisation recommendations.
Features, supported AI providers, refresh frequencies and data availability may vary by plan, market and third-party provider access.
3. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding agreement. You agree to provide accurate, current and complete account information and to keep it updated.
You are responsible for protecting account credentials and for activity performed through your account. Contact us promptly if you believe an account has been accessed without authorisation.
4. Subscriptions, billing and taxes
Paid plans are billed in advance on the monthly, annual or other billing cycle selected at checkout. Unless cancelled before the next renewal date, recurring subscriptions renew automatically using the payment method on file.
Prices, plan limits and included features may change. Where reasonably practicable, we will provide notice before a change affects an existing paid subscription. Fees are exclusive of applicable taxes unless stated otherwise. You are responsible for taxes, duties or similar charges associated with your purchase.
Refund eligibility is governed by our Refund Policy.
5. Acceptable use
You may use the Service only for lawful business, research or personal purposes. You must not:
- reverse engineer, decompile, probe or attempt to extract source code, models, credentials or security mechanisms;
- circumvent plan limits, access controls or usage restrictions;
- use the Service to violate privacy, intellectual-property, contractual or other legal rights;
- upload malicious code or interfere with the availability, integrity or security of the Service;
- resell, sublicense or share account access except where your plan expressly permits it;
- use outputs as the sole basis for decisions that create legal or similarly significant effects without appropriate human review; or
- misrepresent analytics, estimates or AI-generated content as guaranteed facts.
6. Customer data and instructions
You retain ownership of brand information, questions, prompts, files and other material you submit to the Service (“Customer Data”). You grant us a limited licence to host, process, reproduce and transmit Customer Data only as needed to operate, secure and improve the Service and to provide requested support.
You are responsible for ensuring that you have the rights and permissions required to provide Customer Data and instruct us to monitor the selected brands, entities, competitors, questions and markets.
7. Intellectual property
We and our licensors retain all rights in the Service, including its software, user interface, designs, documentation, trademarks, reports, methodologies and underlying technology, excluding Customer Data. No rights are granted except the limited right to use the Service during an active subscription in accordance with these terms.
Feedback or suggestions may be used by us without restriction or obligation, provided we do not identify you publicly without permission.
8. Third-party AI services and data accuracy
The Service relies on third-party AI models, search providers, websites, APIs and infrastructure that we do not control. Their outputs, availability, citation behaviour and terms may change without notice.
AI-generated answers and MentionedBy AI analytics may be incomplete, delayed, inconsistent or inaccurate. Rankings, visibility scores, sentiment classifications and recommendations are analytical indicators, not guarantees. You should independently verify material information before acting on it.
9. Availability and changes
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability. We may perform maintenance, change features, replace providers, impose reasonable technical limits or discontinue parts of the Service.
We may update these terms from time to time. Material changes will be posted on this page or otherwise communicated where required. Continued use after the effective date of updated terms constitutes acceptance.
10. Suspension and termination
You may stop using the Service and cancel renewal at any time through the available account or billing controls. Cancellation does not automatically create a right to a refund for the current billing period.
We may suspend or terminate access if you materially breach these terms, create a security or legal risk, fail to pay fees when due, abuse third-party services or use the Service in a way that could harm us, our providers or other users. Where appropriate, we will provide notice and a reasonable opportunity to remedy the issue.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement and warranties arising from course of dealing or usage.
We do not warrant that any monitored AI provider will display, cite, rank or describe a brand in a particular way, or that recommended actions will produce a particular business, marketing or search outcome.
12. Limitation of liability
To the maximum extent permitted by law, MentionedBy AI and Synapse Artificial Intelligence Labs will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses, or for loss of profits, revenue, goodwill, data or business opportunity arising from the Service.
Our aggregate liability arising from or relating to the Service will not exceed the fees you paid to us for the Service during the three months immediately preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot legally be excluded.
13. Governing law
These terms are governed by the laws of Sri Lanka, without regard to conflict-of-law principles. The courts of Sri Lanka will have jurisdiction over disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere.
